Every country has its own specifics when buying and selling real estate. If you are considering buying any type of property abroad, we have prepared for you a few tips for the questions you are looking for, or will be looking for answers to.
As citizens of a member state of the European Union, we have certain advantages if we decide to buy a house, apartment, or any other property in another EU country.
However, each country has its own specifics. First, answer the question in which country you would like to buy the property.
In Spain, apartments in condominiums or apartment resorts with swimming pools and full service like a holiday resort dominate. Italy is completely different in this respect, and here the interest in standard houses, flats or apartments prevails not only on the coast, but also in cities or inland.
Taxes and fees must be added to the purchase price in each country where you want to buy a property. In both Italy and Spain, it is between 9 and 13% of the purchase price. These fees include, for example, property transfer tax or notary services (in both countries, the notary has a verification and registration position). Therefore, contracts are signed exclusively at a notary.
The purchase contract must be signed by a notary and unless you speak fluent Italian or Spanish, it must be in two languages. Either Italian and English, or Spanish and English, etc. Therefore, in the interest of your own protection, it is essential that you have the contracts consulted and translated into Slovak by a Slovak-speaking lawyer who will familiarize you with the content of the purchase contract and can communicate with the buyer and the notary in the given country on your behalf.
In both countries, the buyer must obtain a tax registration number before purchasing the property. In Italy, it is the Codice Fiscale and in Spain, it is the NIE Número de Identificación de Extranjero. You will then need a valid passport or ID card, a bank account in the country, and a power of attorney if you cannot attend the signing in person.
The entire process from acceptance of the price by both parties, then signing the reservation contract, preparing the signing of the purchase contract at the notary, to the transcription in the real estate cadastre, takes from 1 month to about 3 months in both countries.
